Please read the following communication between AccessWork Staff and Ourselves after we submitted a notice to them that we were vacating their office premises due to severe lack of quality in the services rendered and questionable business practices including but not limited to nonfiling of TDS and GST deducted, not payment of rental to the building owner as a result of which the building owner put up several notices in the building stating AccessWork failed to clear its dues. To date, the company has failed to refund my security deposit of 70, 000 INR against which a legal case in ongoing.

Hello,

After careful consideration of the current situation and the continuous problems faced over a long period of time, we have decided that we would like to discontinue our office rental space from AccessWork from this month, 30th of September shall be our last working day within the premises. Our payments are already cleared for the services till the 30th of this month. So I am not anticipating any kind of billing issues.

As per the agreement and the terms, the security deposit of 70, 000 shall be refunded to us by no later than 30th December, hopefully without any kind of further problems and delays being causes by AccessWork.

Thank you for your efforts all this while, please let us know if you need anything else from us.

Dear Mr. Raha,

Good Evening!

We are sorry to hear about your decision but as you are already aware we do not have a pre termination clause & hence your agreement end date shall remain the same as 31st May 2020.

Post our telecom yesterday it was mentioned to me that you will pay off the dues by 30th Sept 2019 to which we mutually agreed as well. Mr. Raha, I would request you to kindly re think over your decision as we will be unable to pre terminate the existing contract as requested, also the retainer will stand forfeited to Accesswork as per the accepted terms & conditions of your Agreement.

I hope you will understand & cooperate. Do let me know if you would like to discuss the same further over a call.

Please find the online service Agreement for your kind perusal.

Since this is an online service agreement it is only loaded in our system once you accept the link sent to your registered email ID & the Internet log in credentials are generated once done. (I have attached both for your reference).

Do let me know if you would want me to share the email communication with a confirmation on your extension from Jun 2019 onwards from your end as well.

I do not see any signatures, nor do I see any email from my end confirming the acceptance of the agreement. In fact, I have a copy of email of me requesting for a copy of the agreement which was never responded to nor replied.

If you want to go the legal route, good luck defending this in the court of law and I would be more than glad to flex my legal muscles (which I have in plenty) to recover my retainer.

Please find the email communication of our proposal & your acceptance.

As mentioned in my previous email also, the agreements are not loaded unless you accept the same online & invoices are only generated post the same.

I have been only trying to request you to kindly adhere to the existing contract & sort this amicably as this decision of yours is only based on the retainer of Primechain Technologies which will be refunded anyway by the 30th of this month as confirmed to Ms. Shinam. I think let us have a fair deal here & not discuss legalities as we genuinely do not wish to inconvenience you or your team.

Good Morning!

It has been noticed that you have vacated our premise without any prior intimation & the outstanding dues towards the invoices which are generated for the month of Oct & Nov 2019. Your Agreement still stands valid until 31st May 2020.

Your total outstanding due is INR 49, 206/- which is unpaid & hence we request you to kindly have the same cleared at the earliest failing which a legal notice will be sent across to you for the breach of contract & non-payment.

I owe AccessWork money? You must be joking.

My last invoice was paid for services till the 30th of September and services were not used for a single day after 30th of September, so there is no invoice or dues for the month of October or November.

There exist no contacts that I signed or that was shared with me, the only contract that I signed and was shared with me, a copy of which is present with me in print is the one from last year. Sending a link that
opens a 404 Page Not Found error and claiming that link is for the contract renewal is called FRAUD and not an extension of the agreement.

Get back to me within 72 business hours with the precise date by when you will be refunding the retainer fee that has been paid, failing to which a complaint about FRAUD & CHEATING will be filed at the
local police station and legal course of action will be taken.

The entire AccessWork experience has been an inconvenience literally from day 1 ever since we moved in with months of nonfunctional internet, nonfunctional air conditioning and whatnot.
The entire space and facility is in shambles, with broken washroom doors, non-functional internet, panels falling off from the ceiling almost killing someone, no coffee in the coffee machine for 2 days
since you don’t pay your vendors on time, no payments to your security contractors for months, non payment of your rentals with notices being put up on the building, non-payment of TDSes being deducted,
heck even your employees don’t last for more than a couple of months. I can go on and on but you get the point.

If you want to talk about agreements, you have failed to live up to your side of the agreement and frankly, I should be claiming damages instead.

As per the public opinion very nicely shared on various AccessWork public profiles, this is what the operational practices and culture of AccessWork it built upon it seems. Fraud and cheating.

I am sure AccessWork wouldn’t like all of this information to land up in the public domain, ranking on the first page of Google when someone searches for AccessWork and being shared with the rest of its client base
and being discussed on some of the most prominent startup groups and forums in India.

The only way to amicably resolve this would be to part ways effective from the given date and rightfully refunding retainer by the given date.
