hello sir,

I am usha.. took personal loan in Family credit bangalore indira nagar branch, after 9 months i went for pre closure, i took 42k and paid for 9 months about 24k and they are asking me to pay 39k if i want to pre close… i can not pay so much… i said the same to them… but there is no responce…thiere intrest rate is 55%..and i have the records for that, i asked for the agreement copy signed by me at the time of taking loan to show it to a legal adviser, they are not giving that also… from past 4 months i have stopped ECS from bank and they are not coming to collect the balance amount from me, they are making me a defaulter though i want to pay. Will it be a problem for me?? Please help me in this by telling me the proper rules and what is the standrd intrest rate which a finance firm can take according law. And please take proper action on them.

Respected Sirs/Madams,
My brother subhasish mukherjee took a personal loan of 51000/- from Family credit bank, (branch: chandannagar, hooghly, west bengal) in may 2008 . The EMI for 51000 loan was 3300/- !!!
My mother went to preclose the personal loan at 9th february, 2009 and paid approximately 48600/- as suggested by bank manager . The bank manager gave the receipt of closure of the loan. Now on 15th february the bank send a collection agent to my home and asking for 3300/- more for closure of the loan, my mother send someone to bank 3 days later to pay 3300/- and then the bank asked for 600/- more, and finally next day another collection agent came to my home and collected 3900/-

I still do not know how many more times the collection agent will come to our house to collect money.

I do not understand how the govt is allowing private banks to harras customers like this.

Sir,

I took a loan for purchasing a car last year from “:Family Credit Ltd”, Chennai. My EMI was deducted by bank through Electronic clearance system (ECS) on 5th of every month. When I wanted to foreclose the loan on 22 of Jul 09, I was told that I cannot do this after 20th of any month and I can only do so after the next ECS. So I went to them on 6th of Aug and gave a cheque for foreclosure. Besides being forced to pay an extra interest between 22 of Jul to 5th of Aug, they also deducted more than Rs 700/ as interest over and above the normal interest on the pretext that the next couple of days are bank holidays.

The most unpleasant experience comes after this. They refused to issue “No Objection certificate” to enable me to close the “Hypothecation” in the RC book. They said that the certificate will be issued only after 30 days from their Calcutta branch. Now I had sold the car to someone for a very good deal after advertisement in the local paper. The person returned the car for want of this certificate. Now the money I paid for the advertisement is gone and I have to wait for one more month for this certificate

No other company in India does this. The banks issue the certificate immediately on full payment for foreclosure. The agent who arranged for the car loan initially had not explained this to me because I would have never opted for the Family Credit Ltd had I known this. I am now stuck.

I took a 2 wheeler loan for purchasing a Suzuki Access Bike. I took a loan of Rs 38000/-.After paying 10 installments of Rs 2381/ – I wanted to preclose the loan. So I contacted the Family Credit office in Indiranagar.I met the branch manager Mr. .Srijith {Mob # [protected]} and he told me to pay the remaining Rs 14000/- to preclose the loan. I paid every penny to Family Credit and he issued a preclosure receipt and informed me that it would take 21 business days to receive the NOC and Form 35 to get the vehicle transferred to my name in the RTO.
However to my shock – FAMILY CREDIT collected the next month EMI of Rs 2381/- even after closing the loan 20 days before the EMI.I called up Srijith and he coolly informed that it was not their fault .Iam very much depressed by the service and want to take some action on these guys. Anybody interested in taking up this case can contact me @ [protected]@yahoo.co.in
Iam ready to share 50% of the compensation.

i, kiran kumar, had recently shifted to chennai from hyderabad and had been provided with a mobile phone ([protected]) from my employer. from past one week, i am getting this auto dialer calls from [protected] with some message in tamil, which i can't even understand. later taking help of my colleague i came to know that the call was from family credit india. i then called their toll free number [protected] on 14th dec and informed them about the auto dialer call and warned them not to disturb me. and since then i got about 6-8 calls in the last today and today (16th dec) i again got a call in the afternoon which i disconnected and called their toll free number again and i warned them that if i get one more call from their auto dialer number, i will sue them. and now 8pm, i got a call again from their auto dialer number. i tried calling their toll free number, but no one is responding…. i tried visiting their website which is not functioning…

We applied for a two wheelor loan some where around 26 Sep 09. Their executive told us that we might require a Guarantor for a loan which amount only Rs. 28 K. and the best part was that executive himself had no idea about the definition of the Guarantor. Even their Area manager also did not know the definiton of the gurarantor and I had to show them the defintion on the form itself.

After 3 weeks their executive told us that we would need a Guarantor. We somehow arranged a guarantor and our application was logged in again in the 1st week of Nov (they are saying it). Then the executive went on leave for almost 2 weeks. She did not ask anyone to follow up on our application. When I went to follow up, they said that they did not follow up requests older than a month. What an irresponsible answer and their executive never picked up my call neither answer any of my SMS.

After struggling I got the number of Area Manager who tried to make things right. This further resulted in revarification of the applicant and the guarantor. Today is 21 Dec 09 and they are still processing my application. Now they are asking that the amount they have mentioned in the cheque was wrong. So I have to submit the new cheques tomorrow. I am an employee who works in 9-6 pm shift and can not go to office. They don't have curtesy to send someone to collect the cheques.

We booked our Suzuki Access on 21 Sep 09 and we are still waiting for the bike because of Family Credit Process. No body knows nothing in this company. No one held himself accountable and if one does, he is let down by the other department. They are saying that they are taking special approval of the loan from their Mumbai head branch and it took them 2 weeks still in process. Can't help it hopeless service, hopeless people resulting in hopeless company.

I have financed my bike from your organization with the following details.

I have issued a Post Dated Cheque (PDC) of Rs 2024 for the first installment and the subsequent installments were supposed to be deducted from my bank account through ECS. I have also filled up the required form for ECS formalities. In spite of the ECS instructions, I found that a bouncing amount of Rs 350 has been imposed for the second installment. I believe the ECS instructions were not transmitted to the bank by your organization and hence the bouncing amount has been levied.

I would request you to kindly revert back the bouncing amount of Rs 350 and start deducting the remaining installment amount from my bank account through ECS.

Please note that there was enough balance in my account for clearing the installments.

I had taken a finance from Family credit bank for two wheleer, after 1 year my cheque has been bounce so i called to bank do a fever come and collect money from me so bank send a executive for clearence of the payment i had ask for ID he showed me a part from that he give me Receipt of my amout which i had paid then after this suddely two executive are came to my House and they forced to family to handover the bike to the bank due to the non payment of the EMI they taken my bike to the bank i stay at badlapur they called me come at andheri for checking after that they told me it is a fraud it happen to you we will take action and revert back to you after that they have kept the bike since from 1 month they are not giving a proper reply not sending the bike they are using my asset

News4u Bureau Report-New Delhi-Adil-Last week a case o[censored]sed car loan from family Credit (NBFC) came in light when one of our associates applied for a used car loan through some vendors whom he contacted through internet turned out to be a disaster. The person got the loan which was half the amount what was promised and above all when he agreed for that even, the loan cheque got bounced. After contacting the banker from whom the loan was approved next day a different cheque was issued of different amount and after plenty of discussions at the loan seekers office then at the Car dealer’s office the cheque was given to be deposited. As the cheque was of the same bank it got cleared within no time, after which the chaos started, bankers through their DSA who issued the cheque was after this person’s life that by mistake it was given to you, now the bank wants that the cheque was to be given to the Car dealer directly. Even these people followed the borrower at wee hours at night, just to pressurize to buy the car immediately.

Next day the borrower started searching for the Banker and the mediator through whom the loan application was processed, luckily he got the address and met the big bosses there. He told his entire story to them and asked for the remedy. Even he told them that his IT Returns in Original was taken by the bank for verification and did not return till then. The Bosses promised to get the solutions within 48 hrs. But unfortunately nothing has been done so far.

Now the question arises that when a bank gives a loan to a customer through their DSA why the DSA keeps the money with them. As in this case the first cheque & the second cheque were of different amounts. As our reporters tried to investigate further in this case interesting reports came in from Family Credit (NBFC). Like in bigger luxury car segment if a person applies for a loan that’s for the Tax purpose, he buys the vehicle on his own then shows the loan later. In that case if there is a loan of 50 lacs for a BMW the borrower gets Rs. 10 lacs at once then after minimum 90 days he gets the rest of the amount. Meanwhile he keeps on paying regular EMI on the entire loan disbursed. The fortunate DSA enjoys the balance amount with the knowledge of the banker.

Now the question arises that are the Official of RBI know about this practice or its Money laundering going on just in front of their nose. Why not this practice should be stopped and a probe should be ordered to investigate this further. When RBI gives a guideline to all the bankers then why it’s not followed properly.

Our reporters are investigating the case further and soon you will get interesting news about certain DSAs who are being benefited by this practice through their good contacts within the bank. A detailed report will be submitted to RBI for appropriate action.
