Dear Sir,
This is to raise a complaint against Ajnara India Ltd; Noida.
I had booked a Flat in Ajnara Integrity Project more than 4.5 years ago and had made around 80%-85% payment till 31th March 2011.
I got this deal from Mr. Vineet Sharma (Sales Head, Ajnara) and at the time of Sales Deed, he mentioned that "Ajnara believes in Quality and Timely Possession". He also assisted me with a Loan facility by IDBI Bank so I provided all the relevant documents to the concerned executive who was sitting at the Project site. Thereafter, Ajnara started sending me Demand Letters for the payments but the progress of the project was too slow so Bank started denying for subsequent disbursements.
As per the Deed, I was supposed to get the possession by June 2011 but it is November 2013 now and everytime I called them to know the possession date they always asked to wait for 3-4 Months and now 2.5 years has been gone.
Few days ago, I called up Mr. Rajdeep Saxena (Accounts Head, Ajnara) to know my outstandings at the time of possession so that I can make a timely arrangement of funds then I came to know that Ajnara is charging interest of 18% on the delayed payments which is around Rs. 2 lacs. I tried to clarify the reason to Mr. Saxena over phone several times that due to the no/delayed progress of the project the payments by the Bank were also delayed. I also met Mr. Sharma and Mr. Saxena in person but nobody was trying to understand my concern and everyone was saying that we are compensating the delay by providing a penality of Rs. 5/sq ft as per the Sales Deed. Both of them also mentioned that if I want I can take the possession immediately but I was surpised how would registration of a property be done when the Project is incomplete.
My concern is that interest should be applicable to the delayed payments when the project progress going on time. If the Project is not showing any progress why will a Bank or an Individual make the payment. I see myself in a huge loss in last 2.5 years since I have been paying interest to the Bank, staying on rent and will have to pay the interest to Ajnara on the delayed payments as well.
So I am interested to go for a legal action now against such fraudulent Deeds where Buyer has to be in loss always.
