Noida Upcoming Projects – Sureshot litigations, delayed or no possessions and no commitment at all.

Alarming situation of Price war in Noida between all leading Developers, heading towards devastating outcome of Non-deliverance of the property in future ultimately leading to litigations.

While i was searching for an apartment for purchase in any of the upcoming projects in Noida especially in Sector 74, 75 ,76 and 78, i realized that the current real estate market situation is in a really sad state.
I fail to understand how all these builders are calculating the viabilities of their projects. The current prices which all these developers are offering are purely impractical as the average FSI cost is Rs. 1,200 per sq. ft. and the cost of construction is Rs. 1,400 per sq. ft. approximately.
It is impossible to understand how these developers are selling the apartments between Rs. 2,500 to Rs. 2,900 per sq. ft. including all charges when the basic costing is atleast Rs, 2,600 per sq. ft.
This shows that all these developers have entered into a price war and they do not intend to develop the projects as they have committed.
RATHER, IT IS IMPOSSIBLE FOR ANY DEVELOPER TO ACTUALLY DELIVER THE PROJECTS.
In addition, it was astonishing to learn that all these developers are selling huge number of apartments through Broker's Consortiums but almost all of them are failing in timely payments of land revenue installments to the authority.
The developers are offering 10% to 12% commission to the brokers and such brokers forward these discounts to the prospective customers thereby creating an alarming situation of price war.
As per my understanding, all the developers will never be able to deliver the projects as they have committed because it is practically not viable for them to construct the buildings after selling them at a rate between Rs. 2,500 to Rs, 2,900 per sq. ft.
IT IS A WARNING FOR ALL THE POTENTIAL BUYERS THAT PLEASE DO NOT RUN AFTER THE CHEAPEST PRICES, RATHER SEARCH ABOUT THE INTENT OF THE DEVELOPER BEFORE INVESTING ANYWHERE. DISCOURAGE BROKER'S CONSORTIUM AS THEY WILL NOT STAND WITH YOU IN FUTURE WHEN YOU WILL REALIZE THAT THE DEVELOPERS HAS STOPPED THE CONSTRUCTION AT THE SITE AND HAS SHIFTED ITS BASE TO SOME DIFFERENT STATE.
IT IS THE TIME TO OPEN OUR EYES AND TO SEE WHAT THESE DEVELOPERS AND BROKERS DOES NOT WANT US TO SEE.

I have booked a Flat L- 703 in NOIDA project Homes 121of AGC RealtyPvt. Limited, JV of Ajnara and Gulshan Homz. I have recently come to know that AGC has changed the Project Layout which was shown to the the consumers at the time of booking of Phase I, II , III of the project and is still available on there website ( enclosed) .This information has been confirmed as true by Mr. Vineet, Marketting Head AGC Realty Pvt. Ltd. AGC is still going ahead an chetaing the consumers as it is not revealing the changed plan on its website … u can still see the old plan.

We booked our flat with you under the presumption that AGC Realty Pvt. Ltd. ( Ajnara and Gulshan Homz)is a reputed and honest builder and shall stand by its commitments. But your building a tower right at the entrance of the project is an act which is detrimental to the interests of all the people who booked flats in this project. This is going to lower the face value of the project and make the project congested. There were two entrances to the parks in the middle of the project now there is only one. The grand entrance with a club and gardens and swimming pool is now replaced with a tower ..blocking sunlight for all people who booked flats facing the park..

This action taken by AGC will reflects very badly upon your reputaion, credibility. Also, this will make AGC stand in que with other fraud small time builders in the market today. We will never suggest AGC to any body in future and shall not like to deal with it ourselves.

This action of AGC makes us feel cheated.

Our experience to own a flat to be built by the builder i.e Ajnara builders at Crossing Republic NH24,Ghaziabad has turned out to be a very sad and horrifying experience to us . We were projected a rosy picture of the project and reliability of the builder and booked a flat therein. However the fraudulent and the malpractices adopted by the builder during the long gestation period has led to the mental agony and pain to a middle income person who has invested his hard earned money into this project to own a dream flat there .

Ever since the flat was booked my me in September 2008 at Monarch Tower,Ajnara Genx,Crossing Republik ,the builder is changing the terms arbitararily.

1) It increased the area of the flat booked from 1610 sq ft to 1750 sq ft without our consent putting the flat owner to financial hardships

2) The possession of the flat which had to be given by December 2010 is delayed without declaring its nearby likely date of handing over the flat

3) The builder is coming up with commercial shops/offices in front of 3 of the main towers facing the lake view/golf course view for which they have charged PLC also. Initially the builder intimated that commercial building shall have only basement and two floors whereas recently they launched and booked commercial shops/offices upto 6th floor in addditon to the basement .It amounts to breach of terms and conditions conveyed at the time of booking.

4) Event the layout of the whole residential complex has been changed to a greater extent to its own financial benefits.

Such fraudulent methods to extract money from the exsisting and potential buyers needs to be thorougly checked by the comcerned authorities with an iron hand so that the interest of the individual flat owners are protected . Would also request all concerned individuals,citizen groups and media to come forward and help to protect the interest of the home buyers .

Dear Team,
We booked Flat in Ajnara Integrity , flat number K-5XX .
But now we come to know that late panelty is imposed on us we have informed at the time of purchase of flat that regarding payment you will get call from Anjara team to submit the payment,
when we receive call from one of Anjara employee with the 1-2 days we made all the payment by check , and all payment were accepted by Ajnara and there was no intimation that you have done late payment therefore late payment will be applicable,now after 1 and 1/2 year when we enquire about delay in possesion of flat and compensation on it ,
The Anjara is saying there is late payment panelty on us os around rupees thirty three thousand something.
We are feeling cheated and no communciation done via email,phone or other medium .
Please do the justice and Help us to waived off late payment fees.

Dear Sir,

Please note my complaints against one builder.

I have booked a flat in January 2009 and they have commited to give me a penalty if they are not to give the possesion after December 2010. They have a grace period of 3 months till march 2011.

I have submitted 2,15, 000 as per their requeirement within 30 days. For the rest payment they have arranged the loan for me from HDFC bank. This is a bank procedure and they sanctioned the loan in Month of July 2009.

Now when I asked for the penalty payment they are saying that we have received the loan amount after 31st March 2009 as per the doscuments.

Why am I responsible for the late payment. I had submitted all the documents in time.

Please suggest and help.

The issues buyers are protesting against
Possession delayed by 2 yrs
Unwarranted Interest levied without any intimation for past 3 yrs.
No details/calculations provided for the extra money charged.
Not paying the penalty to be paid by the builder, though mentioned in the allotment letter.
Higher maintenance / power back up charges.
Demanding cash without receipt for settlement.
After making the payment within 2 days of receiving demand letter, still need to pay interest on delayed payment of 1L – 4L for all the buyers.

I invested 18 months back with virtually "NO Construction" at the site.
I reside in Bombay and kad invetsed for two units in Panorama Project. Thankfully I was keeping a tap on the project through friends and colleagues in Delhi. I didn't pay the installment as i got to know that there was "No Construction" and they had been telling lies on commencement of construction. Every time they were asking for the project start they were told next month. I was bombarded with their calls for the second phase installment. Even one of the lady ended us shouting at me for money.
I have made the payment of just 6 lacs for two units, but there are others who have made the second installment also and Ajnara now puts them in a Catch 22 situation; the 10% company policy deduction would be a huge sum to loose and the construction is not in sight. I have a chain-mail of about 350 investors in Ajnara facing issues with them.

Dear all,
I had "booked"a flat in AJNARA INTEGRITY ,RAJ NAGAR EXTENSION, GHAZIABAD last month at 2555 rs BSP The check did not get debited for more than a month. I knew the builder was playing a cat and mouse game waiting for a new customer to fall into his net at a higher rate ! I called up the fellow who had finalized the deal , all in written , on paper, rates clearly mentioned several times and he kept reassuring me that the deal will be done… The cheque is in accounts… holidays chal rahi hai …etc etc. i even threatened to block the check by my bank.! But by one month I was pretty sure of their game… And VOILA !!! my doubts came true !! The following is the email I got from Amit Singh(the fraudster sitting in the office) few days back..

as per the norms of company flexi plan is not to b applicable due to the reason of early possesion

department company will effect the loss of @150 per sq ft in the terms of interest in this unit,difference in flexi/down payment
plan..so after the final adjustment with the management there is mutual compromise of 50/50% in the funds,
so bhaiya @75 per sq ft cost will be added in ur flat cost..i[censored] will agree than we will present ur cheque
otherwise i will return ur chequeeee…
so reply as soon as possible….

I am absolutely not going to give in to their blackmail So I will block the check tomorrow by calling up my relationship manager. Since this flat was for investment purpose I will shift to some other premium project in Raj Nagar Extension

Dear Sir,
This is to raise a complaint against Ajnara India Ltd; Noida.
I had booked a Flat in Ajnara Integrity Project more than 4.5 years ago and had made around 80%-85% payment till 31th March 2011.
I got this deal from Mr. Vineet Sharma (Sales Head, Ajnara) and at the time of Sales Deed, he mentioned that "Ajnara believes in Quality and Timely Possession". He also assisted me with a Loan facility by IDBI Bank so I provided all the relevant documents to the concerned executive who was sitting at the Project site. Thereafter, Ajnara started sending me Demand Letters for the payments but the progress of the project was too slow so Bank started denying for subsequent disbursements.
As per the Deed, I was supposed to get the possession by June 2011 but it is November 2013 now and everytime I called them to know the possession date they always asked to wait for 3-4 Months and now 2.5 years has been gone.
Few days ago, I called up Mr. Rajdeep Saxena (Accounts Head, Ajnara) to know my outstandings at the time of possession so that I can make a timely arrangement of funds then I came to know that Ajnara is charging interest of 18% on the delayed payments which is around Rs. 2 lacs. I tried to clarify the reason to Mr. Saxena over phone several times that due to the no/delayed progress of the project the payments by the Bank were also delayed. I also met Mr. Sharma and Mr. Saxena in person but nobody was trying to understand my concern and everyone was saying that we are compensating the delay by providing a penality of Rs. 5/sq ft as per the Sales Deed. Both of them also mentioned that if I want I can take the possession immediately but I was surpised how would registration of a property be done when the Project is incomplete.
My concern is that interest should be applicable to the delayed payments when the project progress going on time. If the Project is not showing any progress why will a Bank or an Individual make the payment. I see myself in a huge loss in last 2.5 years since I have been paying interest to the Bank, staying on rent and will have to pay the interest to Ajnara on the delayed payments as well.
So I am interested to go for a legal action now against such fraudulent Deeds where Buyer has to be in loss always.
